Graeme Hall defeats two European arrest warrant requests for serious criminal conspiracies

Graeme has recently successfully defended two European arrest warrant requests in relation to serious criminal conspiracies.

In O v Spain, O’s extradition was sought for allegations of being a member of a criminal organisation involved in a scam worth in excess of EUR 300,000, which sought to induce others to part with their money in order to claim prize money. In quashing the order for extradition, Mrs Justice May found that the European arrest warrant failed, in a wholesale manner, to provide adequate details of the alleged offending, and that further information provided by Spain undermined the description of the offending contained in the European arrest warrant.

In France v B, B’s extradition was sought for allegations of being a member of a criminal organisation involved in smuggling people from France to the United Kingdom. District Judge Ezzat found that the European arrest failed to provide adequate details of the offending and that further information provided by France also undermined the allegations contained in the European arrest warrant.
