High Value Hidden Assets Win
At a contested confiscation hearing, a Resident Judge acceded to Abigail’s oral and written submissions when finding that the Defendant had shown (the onus was on him) that there were not hidden assets.
The result was that the Organised Crime Unit at the Metropolitan Police Service was not entitled to specify certain of the Defendant’s very high value personal effects – including Rolex watches – on the schedule of available assets.
Police had found receipts for a Rolex Sea-Dweller (bought for £13,100) and a Rolex Date-Just (part-exchanged for £8,800) in the Defendant’s home together with his personal paperwork about his mortgages.
Abigail cross-examined the financial investigator at the confiscation hearing and formulated submissions on the balance of the evidence.
Last January, the Defendant was sentenced to 64 months’ imprisonment having been convicted of offences of conspiracy to supply a Class A drug and possessing criminal property.
