Ministry of Defence withdraws refusal under Afghan Relocations and Assistance scheme for counter-terrorism officer who worked with MI6

Rabah Kherbane was instructed in a claim for judicial review which sought urgent relief against the Secretary of State for Defence for their refusal to relocate and assist the family of a man (‘X’) who had worked for MI6 in Afghanistan. X had worked in intelligence operations, including against ISIS, putting both his own life and his family members’ lives at risk. 

After the claim was issued, with a statement of fact and grounds alleging the basis of the Secretary of State for Defence’s decision was unlawful and procedurally unfair, Jay J ordered expedition for a permission decision. Following the order of Jay J, the Secretary of State for Defence agreed to withdraw their decision with costs.
