Nick Brown was junior counsel for the Defendant solicitors in Masterman-Lister v. Jewell [2002] EWCA 1889; [2003] 1 WLR 1511, the Court of Appeal decision which itself led to the passage of the Mental Capacity Act 2005. Since then, he has been involved in a number of cases in which it has become necessary to raise with the court the issue of the claimant’s continuing capacity to litigate in particular proceedings, most recently last year. For many years, he has represented claimants who have lacked capacity in a variety of different legal contexts and clinical negligence has been a significant proportion of his practice.
