UK taxi driver defeats Sudan war crimes and incitement of terrorism charges

AB was subject to an investigation for multiple offences of incitement to commit acts of terrorism in Sudan under s. 59 of the Terrorism Act 2000 by the War Crimes Unit at Counter Terrorism Command (“CTC”) within the Metropolitan Police.

AB, a taxi driver and citizen journalist, had commented on the ongoing conflict in Sudan. He visited Sudan during the conflict, and was vocally critical of the Sudanese Government.

AB was arrested, detained, and accused of inciting acts of terrorism and war crimes in Sudan, including the shooting of a former governor in Sudan, and armed attacks on a hospital. He was bailed with pre-charge restrictions including on travel, residence, and journalistic and protest activity. His digital devices and passport were seized. He was not permitted to visit unwell parents in Uganda.

In opposing an extension to pre-charge bail, Rabah Kherbane was instructed to represent AB and address the allegations faced, including on the geopolitical circumstances in Sudan. The CTC responded that after “careful consideration” of the material and submissions now provided, the investigation would be stopped. AB’s passport, property, and devices were duly returned.
