Zambrano cases: what could Akinsanya mean?

The Court of Appeal has dismissed the Home Secretary’s appeal in Akinsanya, confirming that she misinterpreted UK law when setting the Immigration Rules for Zambrano carers under the EU Settlement Scheme (‘EUSS’). The result is that she will now need to reconsider, and potentially re-draft, Appendix EU of the Immigration Rules as it relates to Zambrano carers, and has expressed her intention to do so by 25 April 2022.

On Thursday 3 March 2022, Doughty Street Chambers will host an online seminar discussing the Court of Appeal judgment, its implications, options available to applicants pending the Home Office reconsideration, and the practicalities of submitting applications - including evidence requirements and late applications. The session will be chaired by Nicole Masri of Rights of Women and speakers will be Simon Cox and Mike Spencer of Doughty Street who acted for Ms Akinsanya, and instructing solicitor Beya Rivers of Hackney Community Law Centre.


There will be live auto-transcription enabled throughout this event and it will be recorded. All guests will have their cameras and microphones turned off automatically for this event. Exclusionary language will not be accepted.
